Transmitting U.S. Citizenship to Children

If your child is not a U.S. citizen and you would like to help them become one, there are many different avenues that you can pursue on their behalf. A child may acquire U.S. citizenship by being born to a U.S. citizen parent or through naturalization of the parent, provided certain conditions are met. A child born to U.S. parents abroad may be recognized as a U.S. citizen through the issuance of a “Consular Birth Abroad”.

Although this is one of the simplest and foolproof methods of obtaining citizenship for your child, there are still complexities which exist, causing this process to be confusing and time-consuming.

Inheritance

Inheriting an estate can be an emotional, complicated process. Unfortunately, there’s more room for confusion when inheritors live abroad. If you’ve recently inherited an estate as a foreign relative, it’s important to know how inheritance laws are enforced and whether estate taxes may affect you.

Inheritance laws govern how people receive their share of assets. They also govern which relatives have a statutory right to claim an inheritance even if they aren’t included in the express terms of the will. Not only will you have to see how the laws affect you and you legally receive the inherited property, but also also, if you live abroad and inherit an estate from an American relative, you must report it to the IRS, and manuever your way through other U.S. tax laws.
